Filing for Divorce in Edinburg

Edinburg residents file for divorce under the rules set by the Texas Family Code. The case goes to the Hidalgo County District Court. Texas requires that at least one spouse has lived in the state for six months and in Hidalgo County for at least 90 days before the petition can be filed. This requirement is found in Texas Family Code Section 6.301.

Texas allows divorce on no-fault grounds under Texas Family Code Section 6.001. This means you don't have to prove that one spouse did something wrong. If the marriage has broken down due to conflict between the two people and there's no reasonable chance of fixing things, the court can grant the divorce. Most divorces in Edinburg and across Hidalgo County are filed on no-fault grounds.

The process works like this: one spouse files a Petition for Divorce and a Citation. The other spouse is served or signs a Waiver of Service. If both sides agree on all issues, an Agreed Decree of Divorce can be filed. If there are disputes over property, children, or support, the case may go to mediation or a hearing before a judge. Either way, there is a mandatory 60-day waiting period after filing before a divorce can be finalized in Texas.

Texas law requires a 60-day waiting period from the date the petition is filed before any divorce can be granted. This applies to all cases in Edinburg and across Hidalgo County, including agreed and uncontested divorces.
