Filing for Divorce in Pasadena

Pasadena residents file for divorce under Texas law. The relevant statutes are in Texas Family Code Chapter 6. You file the Original Petition for Divorce with the Harris County District Clerk and pay the filing fee at that time. The other spouse then needs to be served with the petition and a citation, or they can sign a Waiver of Service if they agree to the divorce.

Texas allows no-fault divorces. The no-fault ground is insupportability under Texas Family Code § 6.001, which means the marriage has broken down due to conflict and there's no hope of reconciliation. You don't need to prove anyone did anything wrong. Fault grounds also exist and include cruelty, adultery, abandonment, felony conviction, living apart for three or more years, and confinement in a mental hospital.

Texas has a mandatory 60-day waiting period from the date the petition is filed before the court can finalize a divorce. The waiting period cannot be waived except in very limited circumstances, such as when there is an active protective order involving family violence. After the 60 days, if both spouses agree on all terms, the case can move to a prove-up hearing. If there is a dispute, mediation or a trial may be needed.

Texas is a community property state. Property gained during the marriage is generally divided in a way the court finds just and right, considering each party's rights. Talk to a family law attorney if you have significant assets or complex property questions.

Divorce Filing Fees for Pasadena Residents

Filing fees in Harris County are set by the District Clerk. A divorce without children costs around $350. A case with children runs about $365. These fees may change, so confirm the current amount with the District Clerk before you file. Additional costs include service of process, which runs $75 to $100 if done by a constable.

If you cannot pay the fees, you can ask for a waiver by filing a Statement of Inability to Afford Payment of Court Costs under Texas Rule of Civil Procedure 145. The court looks at your income and expenses to decide if you qualify. People who receive government assistance or earn below 125% of the federal poverty level generally qualify. You can get this form at the courthouse or from the Texas Courts website.

All official court forms, including the Original Petition for Divorce, Citation, and Financial Statement, are available at no cost from txcourts.gov. Copies of completed case documents cost $1 per page. Certified copies cost $1 per page plus a certification fee. Call (713) 274-7000 to confirm current copy fees.

Filing Without an Attorney in Pasadena

Some Pasadena residents handle their own divorce, especially when both spouses agree on all terms and there are no complex property or child custody issues. Texas courts allow self-represented litigants, though court staff cannot give legal advice. The Harris County District Clerk's office has self-help resources and will direct you to the right forms.

All Supreme Court Approved Divorce Forms are available free at txcourts.gov. These forms cover divorces without children, with children, and uncontested situations. TexasLawHelp at texaslawhelp.org has detailed step-by-step guides for pro se filers. The Texas Department of State Health Services at dshs.texas.gov can provide a verification letter confirming a divorce is on file with the state, which some agencies require for legal or benefits purposes.

If children are involved in your case, Texas requires a conservatorship order and a parenting plan. Child support follows the guidelines in Texas Family Code Chapter 154. Harris County may also require both parents to complete a parenting class when children are part of a divorce case.
