E-Filing and Case Access in Cass County

Cass County requires attorneys to file electronically for civil and family cases. E-filing has been mandatory since January 1, 2016, following a Texas Supreme Court order. Cases filed in the 5th Judicial District Court of Cass County and the County Court at Law must be submitted through efile.txcourts.gov.

The eFileTexas system connects to 21 certified Electronic Filing Service Providers. Self-represented litigants can use the eFileTexas SelfHelp portal to file without an attorney. The court also maintains separate calendars for the 5th District Court, the 102nd District Court, the 202nd District Court, and the County Court at Law. You can check those calendars through the county website or the e-filing portal.

When filing a family case, there's a required form: the Information on Suit Affecting Family Relationship. This must be submitted alongside your original petition. Failing to include it can slow down your filing. Ask the clerk if you're unsure which forms are needed for your type of case.

Accepted payment methods include cashier's checks, money orders, Visa, Mastercard, and U.S. cash. The office does not accept personal checks for court fees.

Divorce Laws That Apply in Cass County

Cass County divorce cases follow Texas state law. The residency requirement under Texas Family Code § 6.301 says at least one spouse must have lived in Texas for six months and in Cass County for 90 days before filing. This rule applies no matter which court handles your case.

Texas allows both no-fault and fault-based divorces. The no-fault ground under Texas Family Code § 6.001 is insupportability. This means the marriage has broken down in a way that prevents any real chance of reconciliation. Fault grounds like cruelty, adultery, felony conviction, and abandonment are listed in Sections 6.002 through 6.007. Proving fault can affect how the judge divides marital property.

There is a mandatory 60-day waiting period under Texas Family Code § 6.702 from the date the petition is filed. The judge cannot sign the Final Decree of Divorce until those 60 days have passed, with narrow exceptions for domestic violence situations.

Texas is a community property state. Under Texas Family Code Chapter 7, the court divides marital assets in a just and right manner. Property acquired before marriage and gifts or inheritances received during the marriage are generally treated as separate property if properly documented and kept separate.
