Filing for Divorce in Crosby County

Texas residency rules require that at least one spouse have lived in Texas for six months and in Crosby County for 90 days before filing. This comes from Texas Family Code Section 6.301. If you meet the state requirement but not the county one, file in the Texas county where you have lived the required 90 days.

Texas allows no-fault divorce. Under Texas Family Code Section 6.001, insupportability is the most common ground. It means the marriage has broken down because of conflict, and there is no reasonable chance of fixing it. You do not need to prove the other spouse did anything wrong. This is the typical ground for most uncontested divorces in Crosby County.

After you file the Original Petition for Divorce, the other spouse must be served. Texas then requires a 60-day waiting period before the divorce can be finalized. That rule is in Texas Family Code Section 6.702. The exception is for cases involving family violence, where the wait can be waived. Once the 60 days pass and both sides agree, the judge signs the Final Decree of Divorce.

Texas is a community property state. Property division in a Crosby County divorce follows Texas Family Code Chapter 7. The court splits marital assets in a way that is just and right. Things you owned before the marriage or received as a gift or inheritance are your separate property, as long as you kept them separate from shared funds.

Note: If you need help paying court costs, ask the clerk about filing a Statement of Inability to Afford Payment under Texas Rule of Civil Procedure 145. Income-based waivers are available.

What Is in a Crosby County Divorce Record

A Crosby County divorce case file includes all documents submitted to the District Court from the time the petition is filed until the case closes. The Original Petition for Divorce opens the file. After that, the file grows with service documents, responses, agreements, orders, and ultimately the Final Decree of Divorce. Financial documents and any orders related to children are also part of the file.

The Final Decree of Divorce is what most people need a copy of. It states all the terms the court ordered: property division, debt assignment, custody and possession arrangements, child support, and spousal maintenance if any. A name change order shows up here too, if one was granted. You need a certified copy of the decree to prove your marital status, change your name on legal documents, or enforce the terms of the divorce order.

Most documents in a divorce case file are public. Some financial exhibits may be sealed or restricted. Access to information about minor children is sometimes limited. If you need a specific document and are unsure whether it is publicly available, ask the District Clerk. The office will tell you what it can release and what requires a court order or special request.
