Divorce Filing Process in Hansford County

To file for divorce in Hansford County, you submit an Original Petition for Divorce with the District Clerk in Spearman. All of the documents filed after that become part of the permanent case record. Texas law under Texas Family Code Chapter 6 governs the process from the first filing to the final signed decree.

Residency is required. Under Texas Family Code § 6.301, at least one spouse must have lived in Texas for six months and in Hansford County for 90 days before the petition can be filed. You must meet both the state and county residency windows before you can proceed.

No-fault divorce is allowed under Texas Family Code § 6.001. The ground is called insupportability, which means the marriage has broken down because of conflict or discord with no real expectation that things will improve. You do not have to show that either spouse did something wrong. Fault grounds, including cruelty under § 6.002 and adultery under § 6.003, are also available but less commonly used.

Once the petition is filed and the other spouse is served, the mandatory 60-day waiting period begins under Texas Family Code § 6.702. The divorce cannot be finalized before those 60 days pass. If both sides agree on all terms, an agreed final decree can be submitted to the judge after the waiting period ends. Cases involving family violence may qualify for a waiver of the waiting period.

Texas is a community property state. Under Texas Family Code Chapter 7, the court divides marital property in a just and right way. Property owned before the marriage, gifts, and inheritances kept separate are generally not divided. Approved divorce forms for uncontested cases are free at txcourts.gov.

What Hansford County Divorce Case Files Contain

A divorce case file at the Hansford County District Clerk's office includes all documents filed during the case. The Original Petition is the first document. The judge's signature on each order is part of the permanent record.

The Final Decree of Divorce is the most important document in the file. It ends the marriage legally and states all the terms.
