Divorce Filing Process in Beaumont

Beaumont residents filing for divorce do so at the Jefferson County District Clerk's office on Pearl Street. Texas state law governs the entire process under Texas Family Code Chapter 6. The city itself has no role in the divorce process beyond being the location of the county courthouse.

At least one spouse must have lived in Texas for six months and in Jefferson County for 90 days before filing, as required by Texas Family Code § 6.301. Since Beaumont is the county seat and the largest city in Jefferson County, most residents will easily meet this requirement.

The no-fault ground of insupportability under § 6.001 is the most used option in Texas divorces. You do not need to show that a spouse did something wrong. If the marriage is broken by discord or conflict with no reasonable chance of reconciliation, that is enough. Fault grounds are also available under Sections 6.002 through 6.007 if the situation involves cruelty, adultery, abandonment, felony conviction, living apart for three years, or confinement in a mental hospital.

After the petition is filed, Texas law requires a 60-day waiting period before the court can sign the Final Decree of Divorce. Uncontested cases move through the system relatively quickly once that wait is over. Contested cases may require mediation, additional hearings, or a trial before the judge. Texas uses community property principles for dividing assets under Family Code Chapter 7.

Texas mandates a 60-day waiting period after filing before the divorce can be finalized. This applies equally to all Jefferson County divorce cases regardless of how simple or complex they are.

Divorce Costs in Beaumont

Filing fees for a Jefferson County divorce vary by case type. Call the District Clerk at (409) 835-8580 or email districtclerk@jeffcotx.us for the current fee schedule before going in. Copy fees and certification charges apply when you request documents. The office can tell you exactly what each type of copy costs.

Fee waivers are available through the Statement of Inability to Afford Payment of Court Costs form under Texas Rule of Civil Procedure 145. If you receive public benefits or earn below 125% of the federal poverty line, you may qualify. Forms are available at txcourts.gov and at the courthouse. The court reviews the application and decides whether to waive fees in whole or in part.

Other costs to consider include service of process, parenting class requirements if children are involved, and mediation fees for contested cases. Attorneys are optional but can be a worthwhile investment for complex property or custody situations.
